5.0  CONTENT

5.1 JOOMLA!AMERICA Hosting servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is STRICTLY PROHIBITED. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property rights, used without proper authorization, together with material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. Subscribers to JOOMLA!AMERICA Hosting service agrees to indemnify and hold harmless JOOMLA!AMERICA Hosting from any claims resulting from the use of the service that damages the subscriber or any other party.

5.2  Pornography, adult content, and sex-related links or merchandising is prohibited on all JOOMLA!AMERICA Hosting servers. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

5.3  JOOMLA!AMERICA Hosting will be the sole arbiter as to what constitutes a violation of this provision. JOOMLA!AMERICA Hosting does not host competitor sites or web pages promoting sites of its competitors.

6.1 JOOMLA!AMERICA Servers form part of collocation centers in various parts of the world, depending on Client requirements. Hosting details of your website, e-mails or any other form of electronic content, should be viewed as renting a specific area on an online server in accordance with the area of the package chosen by the Client. Responsibility of this information is the sole responsibility of the Client. JOOMLA!AMERICA does not accept any responsibility for the loss or damage of information contained on their servers. Our general hosting service do not include back up of your data. You are responsible for the back up of your own files and data, for your own internal network.

6.2    In order to protect the content of their websites, JOOMLA!AMERICA has created various Back Up packages for Clients to choose from and you are STRONGLY RECOMMENDED to sign up for one of the Back Up Packages. Failure to adhere to a Back Ups package is at the sole responsibility of the Client.

7.0  EMAIL

7.1 JOOMLA!AMERICA Hosting servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. JOOMLA!AMERICA Hosting considers spam any mass unsolicited message in the mediums of newsgroups and e-mail. If you are found to have spammed, JOOMLA!AMERICA reserve the right to immediately, without warning, disable your domain. JOOMLA!AMERICA also reserves the right to refuse or cancel service to known spammers. We reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund. This is also true for sites that promote any illegal activity or content they may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited. Moreover, any site selling or promoting bulk email software, service, or addresses is forbidden.

8.0  IRC

8.1  JOOMLA!AMERICA do not allow IRC or IRC bots to be operated on our servers.

9.0  CGI-SCRIPTS

9.1  Every JOOMLA!AMERICA Hosting account comes with its own CGI-bin. Please feel free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effect normal server operation or service to other JOOMLA!AMERICA Hosting customers. For the protection of all our customers, we also reserve the right to discontinue service to those customers who continue to run scripts that effect normal server operation.
