10.0  BILLING

10.1  Depending on the JOOMLA!AMERICA Hosting Package or other service you choose, Client will be invoiced for services provided and in accordance with the price initially agree.

10.2  All invoices for payment will be submitted through JOOMLA!AMERICA online billing system. Payment is demanded on the date of request. Should this not be received up to 3 days from the specified date, services will be automatically suspended and will only resume on confirmation of payment. A reconnection charge of $15 will be made to reactivate the service.

10.3  Clients are able to login to JOOMLA!AMERICA Billing System through www.JOOMLAAMERICA.com where details of all transactions are stored for future reference.

11.0  RESELLING OF DOMAIN SPACE

11.1  JOOMLA!AMERICA currently do not offer a solution for our clients to resell domain space. Any attempt to resell domain space will result in immediate termination of hosting services without a refund of unused services.

12.0  TRAFFIC

12.1  In the event your site will exceed it's traffic limit you will be notified via email at least 7 days in advance when possible, so you will have time to address the issue. Once you have exceeded your traffic limit your site will be automatically suspended until such time that you make arrangements with JOOMLA!AMERICA Hosting. Over limit data transfer costs are $5/gigabyte once you exceed your limit.

13.0  SERVER ABUSE

13.2  Any sub-networks of JOOMLA!AMERICA Hosting and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice.

14.0  INDEMNIFICATION

14.1  Clients agrees that it shall defend, indemnify, save and hold JOOMLA!AMERICA Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against JOOMLA!AMERICA Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless JOOMLA!AMERICA Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with JOOMLA!AMERICA Hosting's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from JOOMLA!AMERICA Hosting's server.

15.0  DISCLAIMER

15.1  JOOMLA!AMERICA Hosting will not be responsible for any damages your business may suffer. JOOMLA!AMERICA Hosting makes no warranties of any kind, expressed or implied for services we provide. JOOMLA!AMERICA Hosting disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by JOOMLA!AMERICA Hosting and its employees. JOOMLA!AMERICA Hosting reserves the right to revise its policies at any time.
